Sport in Spain is “big business” and it is far more regulated than in the Scandinavian countries. An example is the Spanish law on the special conditions of employment for professional athletes. As an athlete or player agent, it is important to keep this in mind when negotiating the conclusion or termination of contracts with Spanish clubs.
The Spanish Sports law and the law on the special employment conditions of professional athletes are examples in Spain of actual legislation within sports.
The general sports law is called Ley del Deporte, and it regulates, among other things, the organization of sports in Spain with a sports council ´El Consejo Superior de Deportes´ as well as specific rules for sports associations, federations, clubs and professional leagues etc.
Especially the law on the special conditions of employment of professional athletes is of great importance when Scandinavian athletes and Spanish clubs face each other in contract negotiations. This law contains provisions on termination clauses, the duration of the contract, the player’s share of a resale, etc.
